By accessing or using our website and services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

2. Services Description

New Fast Way Trade and Logistic LLC provides freight transportation and logistics services, including but not limited to:

  • Full Truckload (FTL) shipping
  • Less Than Truckload (LTL) shipping
  • Expedited freight services
  • Refrigerated transport
  • Flatbed and specialized hauling
  • Intermodal transportation

3. Quotes and Pricing

All quotes provided are estimates based on the information you provide. Final pricing may vary based on actual shipment details, accessorial charges, fuel surcharges, and other factors. Quotes are valid for a limited time as specified and are subject to capacity availability.

4. Shipment Responsibilities

Shipper Responsibilities

As a shipper, you agree to:

  • Provide accurate information about shipments, including weight, dimensions, and contents
  • Properly package, label, and prepare goods for transport
  • Ensure compliance with all applicable laws and regulations
  • Provide necessary documentation for shipments
  • Not ship prohibited or restricted items without proper authorization

Carrier Responsibilities

We agree to:

  • Transport your goods with reasonable care and diligence
  • Maintain appropriate insurance coverage
  • Comply with all applicable transportation regulations
  • Provide tracking information where available

5. Prohibited Items

The following items are prohibited from shipment without prior written approval:

  • Illegal substances or contraband
  • Explosives and weapons
  • Hazardous materials (without proper certification)
  • Live animals (without proper arrangements)
  • Perishable goods (without temperature-controlled service)
  • Currency, jewelry, or precious metals

6. Liability and Claims

Cargo Liability

Our cargo liability is limited in accordance with applicable law and our filed tariffs. For domestic shipments, liability is typically limited to the lesser of the actual value of the goods or the applicable released value rate. Additional cargo insurance is available upon request.

Claims Process

All claims for loss, damage, or delay must be filed in writing within 9 months of the delivery date (or expected delivery date for lost shipments). Claims must include documentation of the loss or damage and the value of the goods.

7. Payment Terms

Unless otherwise agreed in writing, payment is due within 30 days of invoice date. We reserve the right to charge interest on overdue accounts and may suspend services for non-payment. The shipper is ultimately responsible for all charges.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEW FAST WAY TRADE AND LOGISTIC LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, OR BUSINESS OPPORTUNITIES, REGARDLESS OF WHETHER WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9. Indemnification

You agree to indemnify and hold harmless New Fast Way Trade and Logistic LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services or violation of these Terms.

10. Force Majeure

We shall not be liable for any delay or failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to natural disasters, wars, strikes, government actions, or pandemics.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas and applicable federal transportation law. Any disputes shall be resolved in the courts of Harris County, Texas.

12. Dispute Resolution

Before initiating any legal action, parties agree to attempt to resolve disputes through good-faith negotiation. If negotiation fails, parties may pursue mediation or arbitration before filing suit.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website. Continued use of our services after any modifications constitutes acceptance of the revised Terms.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
